Your children are eligible to be on their stepmotherās Small Business plan if they are her legal dependents. This is true even if they do not actually reside in her home. If your children are receiving adequate health insurance coverage by being on her policy, than this should be something that you should be grateful for. However, if they are on her plan illegally, and are not her legal dependents, this could cause problems down the road if there were to be any claims investigations. The insurance company would have the legal right to deny payment of claims if the children are covered under this group health plan outside of the guidelines and requirements of the insurance company. You could resolve this by contacting Aetna and informing them of the situation.
