can employer vary waiting periods for medical benifits

both employees perform same duties and both received medical benefits prior to voluntarily leaving company, employee A is away for 6 months and employee B away for 1 month, employee A is awarded medical benefits immediatly upon returning and employee B is required to reserve 6 month waiting period, is this legal?
